By entering this promotion, entrants will be deemed to have accepted, and will be bound by, these Terms and Conditions and by any other requirements set out in related promotional materials. This will be strictly enforced by the Promoter. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

Entry instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them.

The Promoter takes data protection seriously. By entering this Promotion, you confirm that you have read the Privacy Policy and agree to these Terms and Conditions of the Promotion. By submitting any information required as part of their participation in the Promotion, participants agree to their information being held and processed in accordance with General Data Protection Regulations (EUGDPR) and the Data Protection Act 2018.

1. Promoter’s Name and Address

Coca-Cola HBC Ireland, Huntstown Business Park, Ballycoolin, Cappagh Road, Dublin 11 (hereinafter referred to as the “Promoter”).

 

2. Eligibility

The Promotion is open to all residents of the Republic of Ireland except employees of the Promoter, its related companies, retailers, suppliers and agencies (and their immediate families) or any other person professionally connected with this Promotion.

All entrants must be aged 18 or over.

All entrants will be deemed to have accepted and understood these Terms and Conditions and be bound by them. This will be strictly enforced by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right at any time, without notice, to amend, modify, or change these rules and any Prizes, and to postpone, suspend or cancel this Promotion and any Prizes, or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.

Failure to adhere to these Terms and Conditions may result in disqualification from the Competition and forfeiture of the Prize. This shall be at the sole discretion of the Promoter and no correspondence will be entered into.

3. How to Enter

To enter the competition comment on the Instagram Post Tagging a friend.

4. Promotional Period

This Promotion is open from 00:00 on 06.06.2023 to 23:59 on 11.06.2023.

Winner will be notified on 12.06.2023

5. Delivery of Prizes

Winner will be contacted by Direct message on Instagram to gain additional information. It is the responsibility of the participant to supply the correct personal information and the correct addresses. The Promoter will not be liable for non-delivery of Prizes caused by the provision of incorrect information, postal disputes or other causes beyond its control.

Any Prize that is returned undelivered will be assumed unwanted and the Promoter reserves the right to re-allocate, if time permits, using the same process referred to above in these Terms and Conditions.

 

7. Prize

Prize Includes:

The Prize is offered as stated. You must enter the Promotion for your own personal purposes only. The Prize is non-transferable and must not be sold, auctioned nor advertised for sale whether on the internet, in newspapers or elsewhere. Any person found in breach of this term will be disqualified from participating. No cash alternative, or alternative prize to the stated Prize shall be offered or made available, however the Promoter reserves the right to replace the Prize with an alternative Prize of equal or lesser value.

8. Selection of Winner

One (1) Winner will be drawn at the end of the promotional period from all valid entries received in accordance with these Terms and Conditions by the administrator. All reasonable efforts will be made to contact the winner. However, if the winner has not responded to notification within two (2) working days or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the Prize for any other reason, the Promoter reserves the right to select an alternative winner using the same process referred to above in these Terms and Conditions.

The Prize winner must provide proof of age (ID) before receiving the Prize  - Over 18 Only

Acceptance of the Prize constitutes permission to use the relevant winners name and likeness for the purpose of advertising, promotion or publicity in any media without additional compensation. Should the winner(s) fail or refuse to do so the winner(s) will be deemed to have forfeited their opportunity to win the Prize and be disqualified from the Promotion. The Promoter reserves the right to amend this provision of these Terms and Conditions.

9. Data Privacy

For this Promotion, the Promoter, Coca-Cola HBC Ireland Limited, Huntstown Business Park, Cappagh Road, Ballycoolin, Dublin 11, is the data controller.  You can reach our data protection officer at [email protected]. The sole recipients of the winner’s information besides the Promoter are the associated promotional and fulfilment partners, the Administrators, Return to Sender Charlemont Exchange, Charlemont St, Dublin, D02 VN88, Ireland.

The information collected from the winner is used only for the purpose of administering the promotion, including fulfilling, and delivering Prizes to winner. Entrants acknowledge that this information is collected on the legal basis that it is the minimum necessary to administer the entrant’s desired participation in the Promotion. If you do not provide this information, participation in the Promotion will be factually impossible.

By entering the Promotion, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller and to the Data Controller using third party agencies to process that personal data for the purposes of the administration of this Promotion (where applicable) and any other purposes to which the entrant has consented.

The Promoter and the Administrator will delete the winner’s information 4 weeks after the Promotion ends. You may access your information at any time, or request to correct, erase, restrict its processing, or receive in usable, electronic format on simple email request to [email protected]. You have a right to lodge a complaint with a data protection authority.

10. Limitations of Liability

To the extent permitted by law, the Promoter accepts no liability for any damage, loss or injury suffered due to entering this Promotion or taking up a Prize. Insofar as permitted by law, neither the Promoter nor any promotional parties assume any responsibility or liability for: 

i.          Any incorrect or inaccurate entry, or for any faulty, incorrect, failed, erroneous or failed electronic data transmissions; and/or

ii.         Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of this promotion causing delays or disruption.

The Promoter and any of its associated agencies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the Prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

11. General

The Prize is non-transferable and there are no cash alternatives to the prize in whole or in part. Cash value €0.001.

The Promoter reserves the right to withdraw or amend this Promotion, Prize and or these Terms and Conditions in the event of any unforeseen circumstances without notice

In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of Prizes, the Promoter reserves the right to cancel or amend the Promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

If there is any reason to believe that there has been a breach of these Terms and Conditions, or any behaviour or misconduct on the part of the participants/winner(s) that disrupts either the efficient running of the Promotion, the enjoyment of the Prize or the reputation/integrity of Promoter, the Promoter may at its sole discretion refuse to accept entry or to terminate/suspend the Promotion and/or the entrants/winners.

Neither the Promoter nor any of its associated or affiliated companies shall be liable to any entrant for any cancellation, discontinuance or delay affecting this Promotion.

Neither the Promoter nor any of its associated or affiliated companies shall accept any liability for loss or damages incurred, or responsibility for any claim, as a result of acceptance of the

Prize.

Dates are subject to change.

If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ireland and any disputes shall be subject to the exclusive jurisdiction of the Irish Courts.
